Is a DUI a Felony?

A first DUI is rarely a felony. The only time it would be a felony is if she was in an accident and someone suffered serious injury. Other than that, a first DUI will not be charged as a felony under the laws of the state of Georgia. It is a misdemeanor. Under the law, besides causing a serious injury, a fourth DUI in 10 years is a felony. But you wrote that this is a first DUI charge for her, so she should be charged with a misdemeanor not a felony.
