Question: I am going to be getting a divorce. I caught my husband having an affair. He denied that he was seeing another woman but I looked at his cell phone bill and I noticed he kept calling a number over and over again. He called it at least 5 times a day.
Then I looked at pictures on his phone and I couldn't believe what I saw. It's hard to even write this, because I saw pictures of my sister! And she wasn't wearing anything but a stupid party hat with lights.
I confronted my sister and she admitted to the affair. She said she started seeing my husband 3 years ago when she found out that her husband was gay.
I confronted my husband and he tried denying the adultery. He said that he was just trying to help my sister overcome a lifelong fear of parties. Then he said that he didn't notice that she was naked. Finally he admitted that they had been seeing each other but he said he was just trying to help her get over her husband.
All I want out of the divorce is to keep my dog. He was a stray and we got him form the pound. We saved him. He's a great dog. He's smart and nice and great with kids and I can trust him, unlike my husband. I'll do anything to keep the dog. I was talking to my husband and he said that if he gets the equity in the house I can have the dog.
Have you dealt with pet issues in divorce? I'd like to speak with a divorce lawyer who knows about pet issues and how they can be resolved in a divorce.
P.P. in Roswell
Answer: Pet-related issues are commonly raised in divorce proceedings. If a couple cannot reach an amicable agreement regarding the pet, then the pet becomes part of the negotiating process. We have handled many such cases and the bargaining involving pets can be just as emotional as for children.
Usually the pet involved is a dog or cat, but we have seen bitter disputes about horses, fish, goats, donkeys and birds, to name but a few.
