Question: I'm writing to you because I got arrested in the city of Atlanta for DUI. I need an Atlanta DUI lawyer. I should have known better but I was with friends for my bachelor party. We went to a bunch of bars like The Porter Beer Bar, Northside Tavern, The EARL, The Sound Table and The Clermont Lounge. It was a long night and we started at a concert at the Center Stage Theatre in Atlanta. I didn't think I was that buzzed and my friends were drunk from some Sweetwater 420 and IPA and some other Atlanta craft beers so I said I'd drive. I drove maybe a mile and I got stopped by a Georgia State Trooper who said I was DUI and made me take some tests. I blew and walked and he looked at my eyes. Then I got sick. So he stopped the test. He arrested me for DUI and the Trooper brought me to jail.
I was bailed out and went home. I'm worried that I will lose my driver's license because I didn't take the breath test. What should I do? I've never had an Atlanta DUI!!!
Answer: Thank you for the question. We would need to know some more facts before offering a comprehensive answer. For instance, we would need to know how long ago you were arrested. You have 10 business days to submit an appeal to the Georgia Department of Driver Services for your driver's license.
You state that you did not take the breath test, but did you take a blood test or a urine test? If you refused to take the test offered by the State Trooper, then your license may be in great jeopardy. A refusal can lead to a year's suspension. Also you write that you have “never had an Atlanta DUI.” Does that mean that you have had a DUI elsewhere? If it is within 5 years of this DUI, and you plead guilty or are convicted, then your license will be suspended for a year (assuming that this is your second DUI within 5 years.) If you have had more than 2 DUIs within 5 years, the suspension is longer. Hopefully this is your first DUI charge.
