Question: I need to have a question answered. I got a DUI in Sandy Springs recently. I pled guilty to the DUI charge. I was put on probation.
I'm in sales and I go out to lunch and dinner with clients all the time. Basically I'm expected to show the clients a good time. When we go out I like to take them to restaurants, clubs and bars. I work for a real estate development company in Sandy Springs. When we go out we tend to drink. We don't necessarily drink a lot, but we do have several drinks. It could be beer, wine, vodka, gin, scotch, you get the picture. I pick up the tab. We'll go to places like The Colonnade, Cibo e Beve, North River Tavern, the Pink Pony or Tony's Sports Bar & Grill.
Someone told me that if you are on probation for DUI, you are not allowed to drink at all. That does not sound right to me because everybody drinks and I don't always get drunk, and I don't drive when I'm drunk. So is that true? Can you drink if you're on probation for a DUI? I have friends who have gotten DUI's and I think they still drink.

Answer: If you are on probation for a DUI you should not drink at all. That is actually a condition of your probation. So if you are caught having ingested alcohol, you could face a probation revocation hearing.
A probation revocation hearing is initiated by a probation officer and a judge decides on punishment. In Sandy Springs, one of the municipal court judges would decide on guilt or innocence and the punishment if you are found guilty. If you are found to have violated probation, the judge can sentence you to jail.
