Question: My husband had a child with another woman and we're very worried about his potential child support obligations because we don't have much money.
We were thinking about getting a divorce for a few years because my husband was working all the time and he became verbally and physically abusive when he drank alcohol. He moved out of the house in Roswell and rented his own place in Dunwoody. He was dating several women. One of his girlfriends got pregnant and had a child.
But he didn't know she had a child. She never told him. Now we're back together and we live in the Roswell house. A week ago the girlfriend told him by texting him that she has a child and he is the father.
Obviously we're upset by this news. The kid is now 2 years old. I need to have some child support questions answered. Since they were not married, does he have to pay child support? Since he didn't sign the birth certificate, does he still have to pay child support?
I'm very confused and looking for answers.

Answer: The fact that they were not married and that he did not sign the birth certificate is irrelevant. Under Georgia law, he must pay child support.

The fact that he was told about his child 2 years after birth by text is somewhat suspicious. He should consider requesting a DNA test to determine paternity if there is any question whether he is the child's father.
