Divorce: We don't have kids

Question:   I need a divorce from my husband.  I caught him having an affair with another woman after he told me those days were behind him.  I caught him because I noticed that he was getting emails from a friend of mine and then I opened a few and I read what they were saying to each other and then I could tell what was going on. 

I also caught him having an affair a few years ago and he pretended nothing ever happened but I saw pictures of the other lady and she was nude.  She looked like some aging stripper with a drug problem.

Our kids are grown and out of the house.  So I want to know what issues are important in a divorce situation when there are no kids.  I just want to be ready for this because I think we'll be divorcing soon.  Maybe it will be an uncontested divorce.

Answer:   Without minor children, the focus of your divorce process will most likely be centered on property division (such as pensions, house, cars, bank accounts, investments, art etc.) and potentially spousal support/alimony.

These issues can often times be negotiated by the attorneys for each party so a judge is not required to decide them.  When pensions are involved, sometimes a QDRO will have to be utilized. 

Of course both parties will have to divulge all assets for the negotiations.  We use special forms that help us know what our clients' assets are.  We request and Georgia law requires that the other party disclose all of their assets.
