Question:  My husband wants to get a divorce and I want to know when I should hire a divorce lawyer. We live in Roswell, Georgia and we've been talking about breaking up for several years and he said that he's hired an attorney and that I don't really need my own lawyer because he'll be fair.

We have 3 small kids and I haven't worked since we got married, which was the same year I graduated from Georgia State University. We own a house here in Roswell and a beach house in Florida. We have a lot of debt from these rental houses that my husband buys and tries to fix-up and rent and from his gambling problem.

We're getting divorced because he's having an affair with a lady who works at Avalon, the big development in Alpharetta. I think she works at a restaurant or maybe a store. I know they're seeing each other because I saw pictures that she sent him and a movie that they made. It was disgusting and it was porn. We tried counselling and the therapist said I needed a divorce because my husband wasn't trying and he seemed like a jerk.

He says that he'll be fair in the divorce but I don't believe him because he's a liar. He was convicted of insurance fraud and did some time in jail, but that was a long time ago. My parents never liked him and he'd always make weird comments to my mother, like he was hitting on her or something.

So now that we're definitely getting divorced, I'd like to know if I need a lawyer and when I should get one.
