DUI: Can I take my drugs while I'm on probation?

Posted by William H. Sherman on Apr 15, 2015 | 0 Comments

Question:  I take different drugs for depression and anxiety.  I was arrested for a DUI in Forsyth and I'm scared that if I'm on probation I won't be allowed to take my medications.  All the drugs are prescription.  My doctor at Northside Hospital in Forsyth said I have to take them.

I got arrested last weekend on Mary Alice Park Road.  The deputy sheriff said I swerved and almost went off the road.  He didn't believe that I swerved because I almost hit a deer.  He said that there was no deer in the road.  I was out by myself at Rick Tanner's Grille & Bar and I had a few at the Cherry Street Tap Room.  I guess I shouldn't have mixed my drugs and alcohol.  I was pretty drunk.

The cop had mw take a blood test so I'm very worried.  I admitted to taking my antidepressants and a few beers.

I really need to know if I get a DUI will I still be able to take my medicines.  If I can't take my drugs then bad things could happen to me.

Answer:   You have no need to worry.  You are certainly allowed to take all of your prescription medications while you are on probation for DUI.  Many people suffer from depression, anxiety and other issues that are treatable by medication.  Obviously, these drugs are medically necessary to help an individual lead a satisfying life.

Of course, illegal drugs like pot, cocaine and meth are forbidden.  If a person on probation is caught taking illegal drugs or drugs that have not been prescribed by a doctor, that would be a serious probation violation.  A probation violation can result in a revocation hearing and being sent to jail.
