I Got Served With Divorce Papers: How Long Do I Have To Answer?

Question: I never thought it would come to this, but I need a divorce lawyer.  I bought my wife pretty much anything she wanted.  I bought her jewelry at places like Shane Co., Solomon Brothers and Buckhead Jewelry;  clothes at Larisa Glazirani and shops at Phipps Plaza and I even paid for a lot of plastic surgery for her breasts, eyes and nose.  I bought her a BMW, Range Rover, Mercedes-Benz and I was going to buy her a Maserati or Porsche this year.  We took a cruise every year.  I bought her expensive wrist watches and I even paid for our dog to have an expensive dog house that cost over $15,000.00.

She got mad at me because I travel on business a lot and she accused me of seeing escorts because there were some credit card charges I couldn't explain.  She accused me of making a pass at her best friend.  I don't think I did but I was pretty drunk.

We live in Milton, Georgia and I work in Sandy Springs.

Anyway when I confronted her about her relationship with her tennis coach she admitted to having an affair.  I thought we'd be able to work it all out but I got served with divorce 2 days ago.  How long to I have to do an answer?  Can the court make her go to marriage counselling?

Answer: Under Georgia law, section 9-11-4, you have 30 days to file an answer with the court.  The statute provides that: “If the answer is not served within this time, a default judgment may be taken against that defendant.”  Accordingly, it is imperative that you contact a divorce lawyer immediately so that an answer can be prepared and that you and the divorce attorney can agree on a plan to address the many issues that can be raised in a divorce.

While a court can order many things, it cannot order your wife to attend marriage counselling.  Marriage counselling can be helpful, and is usually done prior to divorce papers being filed.
