Question: I live in Cumming, Georgia, and I need to get divorced. I want to know if my wife can consent to us getting divorced here in Forsyth County even though she lives in another state.

My wife moved to Florida because we were fighting all the time. Nothing physical, except that one time she hit me in the head. But I let it go because I knew that if I responded I'd have gotten into trouble because they always arrest the man, especially in Forsyth County.

We argued about everything. She always had something to say about my drinking, my hours at work, my going to strip clubs and occasionally looking at porn. I didn't like the way she spent money on clothing, never really worked and was drunk a lot.

So she moved home with her parents, who live in Florida. We don't have any kids, so that's a good thing. And we don't have many assets together.

I really don't think we'll get back together because her mother thinks I'm stupid and I lost my temper with her a few times. She was pissed that I got a DUI, although I wasn't that intoxicated.

Please tell me if we can get divorced here in Forsyth County even though she lives in another state.

Answer: Yes, you can get divorced in Forsyth County even if your wife has moved to Florida. As long as she agrees to jurisdiction, you get divorced in Cumming. In Forsyth County, the divorce would go to superior court.
