In Sandy Springs: Why was I charged with 2 DUIs?

Question: I got into a verbal fight with my husband and I left our house in Sandy Springs.  But I got pulled over on Roswell Road by a Sandy Springs police office.  He said I was speeding.  When he came over to my car he noticed I had a beer bottle on my lap under a magazine.  He charged me with different traffic violations and he wrote out 6 citations.  He even charged me with 2 DUI's.  I don't know why he charged me with 2 DUI's.  Can you tell me why I got 2 DUI charges?  Is Sandy Springs different than other cities?

Answer: Every city and county in Georgia has their own procedures for handling DUI charges.  Although DUI law is the same statewide, of course, each municipality does things slightly differently.  Sandy Springs handles DUI charges in its own unique way.  That is not to say, however, that it handles such charges drastically differently than most cities, it does not.  But Sandy Springs does have its own “quirks.”  As for why you were charged with 2 DUI's, that is likely because the Sandy Springs police officer wrote citations for DUI-less safe and DUI-per se (if you refused a blood, breath or urine test, then you were charged with DUI-less safe).  You should only face one DUI charge, however, and the other charge should be dismissed.
