Milton, Ga. Divorce: My husband sees escorts; He claims that's not cheating

Question:  I live in Milton, GA.  I also need a divorce lawyer just like that man whose question you answered on your blog.  My husband and I have been married since 1980.  We moved from Buckhead to Milton to be closer to his job in Alpharetta.  I was a stay at home mom.

I noticed that on my husband's Facebook page he has been communication with many different women.  When I did some checking it turned out that the women were actually escorts, hookers, prostitutes and massage girls.  Most were from Atlanta but some were Dunwoody and Sandy Springs.  When I confronted him about these types of people he said he met them on Craigslist, Backpage and through newspapers.  And he said he met them online. He said he was a porn addict.

He says that since the ladies were paid that means it wasn't really adultery. He said that adultery is only with a person who is not paid and escorts are paid.  I need to know whether if my husband has relations with prostitutes that counts as adultery or not?

Answer:  Under Georgia law, adultery is having sexual relations with another person.  It does not matter if that other individual is paid or not.  If he had sexual relations with a prostitute that is adultery, even if they just met once.

As divorce lawyers, we have handled many cases involving infidelity.  His excuse has no legal validity and his cheating is, certainly, a ground for divorce.  Indeed, with the great popularity of social media websites like Facebook, Twitter, Instagram, Tumblr, Snapchat and others, divorce lawyers are seeing more and better evidence of infidelity than ever before.  Texts, emails and photographs are commonly used as evidence in divorce cases.  Such evidence can be very compelling to a judge and jury.
