Roswell: Can I get an uncontested divorce?

Posted by William H. Sherman on Nov 23, 2014 | 0 Comments

Question: I think we can get an uncontested divorce.  My wife and I have been married for 8 years.  Six months ago I found out that she was having an affair with our minister.  She wants to try to work things out but I don't want to.  It's not her first affair; this is like her 5th that I know about where she was cheating.  She spends a lot of time on those websites where people want to have flings.

Anyway, we live here in Roswell, just off Canton Street.  We don't own a house; we rent an apartment.  We don't have kids.  And we spoke about dividing up our savings, the checking account and we both have retirement accounts.  I have an IRA; she has a 401 (k).  So we agree on all of that.

Obviously we want to use a good divorce lawyer so that it's all done correctly and there are no mistakes made.  We had friends who tried to do the divorce themselves and it was a horror show, they made tons of mistakes and it took forever (and my friend is paying a lot more money than he should to his ex-wife; and he'll be paying for 3 years longer than he should).  We understand we need a lawyer.

From what I've explained, do you think we can do an uncontested divorce?  We both make good salaries, but if we can we'd like to save some money and we really don't want to fight about this.

Answer: From what you have described, it does sound like you can proceed with an uncontested divorce.  It does not sound like there are any real disagreements.  Of course, many people think that their divorce will be uncontested, only to find out, after they begin the process, that there is at least one issue they do not agree on.  That issue could be child custody, alimony or many other things.  It could be a big issue, or it could be a smaller issue.

We have handled many uncontested divorce matters.  I'm glad you understand that having a divorce lawyer is essential to making sure that the divorce is completed properly without any major problems or surprises.
