Question: I need to get custody of my children. My husband was awarded custody of the kids by a Fulton County superior court judge. I was going through some drug and alcohol issues at the time and I spent a year in rehab. Now I'm fine and I'm back to work at my medical practice as a surgeon. I haven't had a drink or done drugs in over 3 years.
But my ex-husband has been doing things around the children that he should not be doing. He is often drunk around the kids and his girlfriend (who works as a stripper in Atlanta) is there a lot and she walks around topless near the kids. And she'll have her strip club friends hang out at my husband's house on the weekends. My husband often drops the kids off late to their religious private school and he has missed a lot of their extracurricular activities because of work and because of his alcohol problem.
The worst part is that he screams at the kids all the time. He even calls them by cruel nicknames that he made up. He calls our son “the jerk” and our daughter “chubby.” The kids don't want to be around him anymore.
Do you think I have a good chance of getting custody of the kids under the custody laws? I'm not looking for a custody battle, but I'll fight for the kids. I need a custody lawyer. I live in Sandy Springs.
Answer: It sounds like you have a strong case for child custody. The standard the court uses is the best interests of the child. You describe a domestic situation that is bad for a child. There are drugs, alcohol, emotional abuse and the presence of unsavory and perhaps threatening individuals to whom the children are exposed.
You need to document your allegations. Any evidence that you can obtain will greatly help as you pursue your case. If you can gather pictures or video of some of the things you describe, that can have a very compelling effect on a court.
